If the said Hugh Pollock Tooker shall at any time neglect or refuse or from any cause (other than illness not caused by his own impropriety of conduct) become unable to perform or comply with all or any of the Articles of this Agreement, or all or any of the duties required of him or all or any of the orders or directions of the Government or its representatives or shall in any manner misconduct himself it shall be lawful for the Government to declare the employment of the said Hugh Pollock Tooker under this Agreement to be at an end and thereupon his engagement shall cease and this Agreement shall not have any further prospective operation or force and all rights and benefits reserved to the said Hugh Pollock Tooker shall cease, but without prejudice to the enforcement of existing claims.

The said Hugh Pollock Tooker agrees to make no claim upon the Government or on the Crown Agents for the Colonies in respect of the fluctuations in the value of the dollar.

The said Crown Agents for the Colonies shall not be personally liable for anything contained in this Agreement.
